Welcome to Fiction Flock! These Terms of Service (“Terms”) are a legal agreement between you and Fiction Flock (“Fiction Flock,” “we,” “us,” or “our”), and they govern your use of the website at fictionflock.com and any related features, content, and services (together, the “Service”).
By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
1. Who we are
Fiction Flock is an online community and recommendation platform for readers. We share book recommendations, reviews, lists, reading challenges, and other bookish content, and we let members create profiles, save books, take part in reading activities, and earn rewards.
2. A note about our beta
The Service is currently offered on a beta or early-access basis. That means features may change, break, or disappear, and content or data may occasionally be lost. We provide the Service “as is” while we build and improve it (see Section 12).
3. Eligibility and your account
- You must be at least 13 years old to create an account or use the Service. If you are under 18, you represent that you have your parent or guardian’s permission.
- You’re responsible for the information you provide and for keeping your login credentials secure. You’re responsible for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- We may suspend or close accounts that violate these Terms.
4. Community guidelines and member conduct
Fiction Flock is meant to be a warm, welcoming place. When you post reviews, recommendations, comments, profile content, or any other material, you agree that you will not:
- Post content that is unlawful, harassing, hateful, threatening, defamatory, or invasive of someone’s privacy;
- Post sexually explicit material involving minors, or any content that sexualizes minors, in any form;
- Impersonate others or misrepresent your affiliation with any person or organization;
- Post spam, advertising, or content that isn’t genuinely about books and reading;
- Upload viruses or malicious code, or attempt to disrupt or gain unauthorized access to the Service;
- Scrape, copy, or harvest content or data from the Service except as expressly allowed.
We may remove any content and suspend any account, at our discretion, to keep the community safe.
5. Content you create
You keep ownership of the reviews, lists, recommendations, profile text, images, and other material you submit (“Your Content”). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and share it in connection with operating and promoting the Service. You can remove Your Content, and we’ll stop displaying it going forward, though copies may remain in backups for a period.
You’re responsible for Your Content and confirm you have the rights to share it and that it doesn’t infringe anyone else’s rights.
6. Reader in Residence and contributor content
Some members may contribute as “Readers in Residence” or other featured contributors. Unless we agree otherwise in writing, contributions are made voluntarily, the contributor keeps ownership of their work, and the license in Section 5 applies. Featured status is offered and may be ended at our discretion.
7. Giveaways, challenges, and prize drawings
From time to time we run reading challenges, quests, and giveaways or prize drawings.
- No purchase necessary. Entries (for example, “feathers” or giveaway entries) are earned for free by participating in activities on the Service. No payment is ever required to enter or win.
- Who can enter. Unless a specific giveaway says otherwise, entrants must be at least 13 years old. Entry is open to participants regardless of where they live, except where prohibited by law (void where prohibited).
- Prize shipping. Physical prizes can only be shipped to addresses within the United States, including U.S. military APO/FPO/DPO addresses.
- Winners we can’t ship to. If a winner’s address is outside the area we can ship to (for example, an international address), the winner will instead receive a digital alternative prize — a digital gift card (such as an Amazon eGift card) valued at US $25 — in place of the physical prize. The value of the alternative prize may be less than the retail value of the physical prize.
- Entry and drawing. Each giveaway will state how to earn entries, the entry deadline, the prize, and the number of winners. Winners are selected from among eligible entries after the entry deadline.
- Winner notification. Winners will be notified using the contact details associated with their account and may be asked to confirm eligibility and provide the information needed to receive a prize. If a winner can’t be reached or doesn’t respond within a reasonable time (for example, 7 days), we may select an alternate winner.
- Prizes are as described for each giveaway, are non-transferable, and may not be exchanged for cash unless we say otherwise. Winners are responsible for any applicable taxes.
- We may modify, suspend, or cancel a giveaway if it can’t be run as planned (for example, due to fraud, technical failure, or circumstances beyond our control).
8. Affiliate links and disclosure
Fiction Flock participates in affiliate programs, including the Amazon Associates Program and Bookshop.org. This means that when you click certain links to books or products and make a purchase, we may earn a small commission at no extra cost to you. As an Amazon Associate, we earn from qualifying purchases. Affiliate relationships never change the price you pay, and our recommendations reflect our genuine enthusiasm for the books, not the commissions.
9. Subscriptions and payments
If the Service offers paid memberships, subscriptions, or purchases, the price, billing cycle, and what’s included will be shown before you pay, and fees will be billed through our payment processor. Unless required by law or stated otherwise, payments are non-refundable. You can cancel a recurring subscription at any time, and it will remain active through the end of the current billing period. (Fiction Flock may be free to use; this section applies if and when paid options are offered.)
10. Our intellectual property
The Service itself — including our name, logo, design, original written content, and software — belongs to Fiction Flock or our licensors and is protected by intellectual property laws. Book titles, cover images, author names, and book descriptions are the property of their respective owners and are used to identify and discuss books. You may not copy, reproduce, or reuse our content except for your own personal, non-commercial use, or as allowed by law.
11. Third-party services and links
The Service links to and integrates with third-party services (for example, booksellers, email tools, and book-data providers). We don’t control those services and aren’t responsible for their content, products, or practices. Your use of them is governed by their own terms and privacy policies.
12. Disclaimers
The Service and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent allowed by law. Book recommendations and content reflect personal opinions and are for general enjoyment and information only. We don’t guarantee that the Service will be uninterrupted, error-free, or secure, or that any content is accurate or complete.
13. Limitation of liability
To the fullest extent permitted by law, Fiction Flock and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the total amount you paid us in the 12 months before the claim, or (b) US $100.
14. Indemnification
You agree to indemnify and hold harmless Fiction Flock and its owner from any claims, losses, or expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
15. Termination
You can stop using the Service and close your account at any time. We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, and limitations of liability) will survive.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll update the “Last updated” date and, where appropriate, give notice through the Service. Your continued use after changes take effect means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Service will be handled exclusively in the state or federal courts located in Bexar County, Texas, except where prohibited by law.
